Terms of Service

1. Acceptance of Terms

By accessing or using IncentivIQ at claimpilot-ca.polsia.app (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

If you do not agree to these Terms, do not use the Platform.

2. Service Description

IncentivIQ is a Canadian government incentive eligibility assessment platform. It helps businesses:

• Identify federal and provincial incentive programs they may qualify for
• Receive directional estimates of potential claim values
• Understand program requirements and next steps
• Download eligibility reports in PDF format (paid tier)

IncentivIQ matches businesses against a database of government incentive programs based on information provided by the user. Results are informational only.

3. Not Tax, Legal, or Accounting Advice

Specifically:

• Eligibility assessments are informational estimates, not professional opinions
• Claim value estimates are directional approximations based on publicly available program information and the data you provide — they are not guarantees
• Program eligibility criteria, rates, and deadlines change — government programs are subject to modification or discontinuation at any time
• Actual eligibility determinations are made by the Canada Revenue Agency, Innovation, Science and Economic Development Canada (ISED), or the relevant provincial authority

Before filing any tax credit claim, grant application, or incentive program submission, consult a qualified tax professional, SR&ED consultant, or accountant.

IncentivIQ is not responsible for any decisions made based on the Platform's output. See Section 9 (Limitation of Liability) for details.

4. Account Eligibility

To use IncentivIQ, you must:

• Be at least 18 years of age
• Have the legal authority to enter into these Terms
• Provide accurate information about your business
• Not be barred from using the Platform under applicable law

You may use the eligibility assessment without creating an account. Account creation is required to save results, access paid features, or download reports.

5. User Responsibilities

You agree to:

• Provide accurate, truthful information during the assessment process
• Keep your account credentials confidential
• Notify us immediately at hello@incentiviq.com if you suspect unauthorized account access
• Use the Platform only for lawful purposes
• Not attempt to reverse-engineer, scrape, or copy the Platform or its program database
• Not misrepresent your business to obtain higher eligibility estimates
• Not use the Platform to assist others in filing fraudulent government claims

You are responsible for all activity that occurs under your account. We are not liable for losses arising from unauthorized use of your credentials.

6. Subscriptions & Payment

Plans

IncentivIQ offers free and paid subscription tiers. Paid plans unlock full eligibility details, estimated claim values, PDF reports, and additional features. Current pricing is displayed at incentiviq.com/pricing.

Billing

• Subscriptions are billed monthly or annually as selected at checkout
• Payment is processed by Stripe. By subscribing, you agree to Stripe's Terms of Service
• All prices are in Canadian dollars (CAD) unless otherwise stated
• Applicable taxes (GST/HST/PST) may apply based on your province

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. We will send a renewal reminder by email 7 days before annual subscription renewals.

Price Changes

We may change subscription prices with 30 days' notice. Price changes take effect at your next renewal date. If you do not agree with a price change, you may cancel before it takes effect.

7. Cancellation & Refunds

Cancellation

You may cancel your subscription at any time through your account settings or by emailing hello@incentiviq.com. Upon cancellation:

• Your paid access continues until the end of your current billing period
• Your account reverts to the free tier at the end of the period
• Your saved data is retained for 12 months following cancellation, then deleted

Refunds

• Monthly plans: No refunds for the current billing period. Cancel to prevent future charges.
• Annual plans: Pro-rated refunds are available within 14 days of the start of a new annual term, minus any months already used. No refunds after 14 days.
• Exceptions: If the Platform was unavailable for more than 24 consecutive hours in a given billing period due to our error, you may request a pro-rated credit. Email hello@incentiviq.com.

To request a refund, contact hello@incentiviq.com with your account email and reason for the request. Refunds are issued to the original payment method within 5–10 business days.

8. Intellectual Property

Our Property

The IncentivIQ platform, including its source code, program database, matching algorithm, design, content, and brand assets, is owned by IncentivIQ and protected by Canadian copyright law. You may not copy, reproduce, or create derivative works without written permission.

Your Data

You retain ownership of the business information you input into the Platform. By using IncentivIQ, you grant us a limited licence to process that data for the purpose of delivering the service (running assessments, generating reports, improving matching accuracy).

Reports

Eligibility reports generated by the Platform are provided for your personal and internal business use. You may share reports with your accountant or advisors. You may not resell or redistribute reports as a commercial service.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• IncentivIQ is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the Platform will be error-free, uninterrupted, or that eligibility assessments will be accurate or complete
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform
• We are not liable for any government denial of an incentive claim, audit, penalty, or assessment arising from reliance on IncentivIQ outputs
• Our aggregate liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Canadian law.

10. Account Termination

We may suspend or terminate your account if you:

• Violate these Terms or our Privacy Policy
• Provide false or misleading information to obtain eligibility results
• Attempt to access the Platform in an unauthorized manner
• Use the Platform to facilitate fraudulent government claims
• Engage in abusive behaviour toward IncentivIQ staff or other users
• Fail to pay any amounts owed after 30 days

We will provide notice of termination by email where reasonably practicable, except in cases of serious violation. If your account is terminated for cause, you are not entitled to a refund.

You may close your account at any time by emailing hello@incentiviq.com.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada.

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will:

• Update the "Last updated" date at the top of this page
• Notify registered users by email at least 14 days before material changes take effect

Your continued use of the Platform after the effective date of any changes constitutes acceptance of the updated Terms. If you disagree with a material change, you may cancel your subscription before it takes effect.
